Elevator Not Working & Heart Transplant

I just moved in to a 5th floor with a heart transplant. The lease said that it was a 6th floor building with an elevator. Once I move in the elevator was out of service and my neighbors tell me that it’s a common issue. Can I take legal action or talk to upper management.
